If you receive a traffic conviction in New York State, West Virginia will be notified of the offense because both states are members of the Driver License Compact.

Unlike some states, West Virginia assesses points for all moving violations committed anywhere in the United States using the West Virginia point system.

Multiple Charges Exception: Drivers convicted of multiple traffic offenses arising out of a single traffic incident will only be assessed the points corresponding to the single most serious offense under West Virginia rules.

Insurance Surcharges & NY DMV Fines

Insurance Premium Increases: Because points and convictions transfer directly to your West Virginia MVR, your auto insurance provider will learn of the New York conviction during routine policy renewals, which can trigger substantial rate hikes or loss of safe driver discounts.

NY DMV Driver Responsibility Assessment (DRA): Regardless of your home state license, the New York DMV maintains a shadow record for all out-of-state drivers. Accumulating 6 or more points in New York within an 18-month period triggers mandatory Driver Responsibility Assessment fees starting at $300 ($100/year for 3 years). Failing to pay will lead to a suspension of your driving privileges in New York.
