Traffic Diversion Programs: 6 New York Counties Where Tickets May be Dismissed

by Seth Azria on 1/31/2018

What is a Traffic Diversion Program?

A traffic diversion program is a method, provided by a county district attorney, to resolve a traffic ticket. The district attorney in each county in New York State decides how to handle the traffic tickets issued in their jurisdiction. When a district attorney decides to adopt a traffic diversion program, successful completion of the program will result in a dismissal of the qualifying ticket. This is the best result possible because a dismissal means there will be no points or fine from the court.

Traffic Diversion Program Requirements

While the specifics of each program differ, each county traffic diversion program requires:

  1. completed application and fee,
  2. completed defensive driving course, and;
  3. interaction with the court.

Qualifying Traffic Tickets

Not all tickets qualify for these programs- the programs generally focus on less serious charges.  The specific requirements for individual counties are listed below. If our client’s ticket does not qualify, we then handle the ticket as normal through negotiations with the prosecutor. If a client is ejected from the program, most commonly for failing to complete the defensive driving course in time, we would also negotiate directly with the prosecution.

Application and Fee

Each diversion program requires that you complete and submit an application. For clients, we complete the application for their signature. The application fees for the traffic diversion programs in New York state are listed below. These payments should be made by certified check or money order. For our clients overseas, or who find it difficult to secure and mail checks, we arrange credit card payments and mail the payment on their behalf.

Defensive Driving Course

There are numerous defensive driving courses that will satisfy the requirements of the traffic diversion programs. These courses cost about $30 - $40 and may be completed online. View Courses. The completion certificate from the course will be required by the traffic diversion program.

Interaction with the Court

Even though you may be seeking to dispose of your ticket through the traffic diversion program, contact with the court is still required. Each program participant must enter a not guilty plea with the court, secure an adjournment of their court date, and then ensure that no court dates are missed. For our clients, we enter the not guilty plea and keep track of court dates.

Counties with Traffic Diversion Programs

Each of the counties below has adopted a traffic diversion program. The descriptions below are summaries of each program's specific eligibility requirements. These traffic diversion programs apply to all courts in a given county. If you plan to represent yourself in the traffic diversion program, we recommend reading the program materials closely.  If you would like a lawyer from our office to represent you, you may hire us online or call, (315) 364-1155, to speak with an attorney.

Client Reviews of Our Traffic Lawyers

Professional and reliable, highly recommended

After receiving a ticket upstate NY, I contacted Seth's firm based on the great reviews on this board and was really happy that I made this choice.

Seth explained the possible outcome in my case when I first called him and managed to achieve exactly what he told me, which shows that he is experienced and knowledgeable in his area of practice. He successfully negotiated with a DA a reduction of charges from a 6 point speeding to a non-speeding violation without me having to appear in court in person.

Monica, Seth's paralegal, kept me informed of all necessary details throughout the whole two month process and I received a response to every email that I sent to the firm.

I would highly recommend Seth's firm for anyone looking for reliable and professional attorney services.

Seth is a good lawyer

Seth and his team helped me out with a speeding ticket I got in Cortland. He was professional and courteous. I spoke with him with-in a hour of leaving a message with his office. All future correspondence was via email, but he was available by phone. I worked with one of his staff members as well. My 31 mph over limit (6 pts) was reduced to non-speeding 2 pts fine. I highly recommend Seth and the Azria Law Firm.

Best Lawyer in Syracuse!

I found Mr. Bruffett after calling several lawyers in Syracuse. I had 6 outstanding tickets that I completely blew off and forgot about until I was arrested in NYC over a suspended license. Mr. Bruffett was able to get ALL of my tickets reduced with NO POINTS and he also got 2 tickets dismissed. When I first met him, it was the most pleasant experience one could ask for. He's one of the few lawyers who actually cares about YOU and not your money. He quoted me an extremely reasonable amount for all 6 tickets. I never had to step foot into a court room and he has a great relationship with the DA and he was able to work something out that was in my best interest. I feel a huge relief knowing all of my tickets are over with, and I could not thank Mr. Bruffett enough. He also gave me his personal phone number and I was able to text and call him whenever I needed him. Before I even retained him, I had a question and texted him and he called me and walked me through the entire process. I highly recommend Mr. David Bruffett and his firm Azria & Bruffett. Thank you for everything David, and although I hope I never have to retain you again, if anything should ever happen, you'll be the first person I go to.
Sincerely, Casey N.

This gentleman works wonders

Due to my reckless decision making I was charged with an aggravated DWI. This could have ended badly for me and left me devastated financially. I hired Mr Habib and he immediately set up a plan of action for my case. Throughout the process he kept me well informed and detailed exactly what he was trying to achieve in my case. This man worked a miracle. Not only did he get the charge dropped down to a DWAI (a traffic infraction) he also mitigated the financial impact this incident would have had on me by thousands of dollars. I can't thank Mr. Habib enough. If you want a second chance this is the man to call hands down. He even went above and beyond to write a letter to my employer to further explain this unfortunate incident. Thanks again, sir.

Google+ Review

After thinking this was a lost cause, my insurance could've gone up and my license been revoked for a speeding ticket and unlicensed operator ticket. Mr. Ralph Habib was able to successfully reduce both charges. Anyone wondering if you should fight a ticket, do so! You have a higher possibility of reducing the charge and pay less by being represented than just paying the tickets and seeing your insurance go up! Highly recommend Mr. Ralph Habib.
